There are questions of a wrongful death after a fatal accident on the Dixie Highway here in Louisville last week.  Police were summoned to the scene of a two vehicle car accident around 4:30 on Friday afternoon.  The driver of a Fiat in one of the northbound lanes had to swerve to miss a vehicle in front of them, oversteering into the oncoming southbound lanes.

The Fiat collided with a Southbound vehicle head-on resulting in serious injuries to the driver of the Fiat and two occupants in the southbound vehicle.  A female passenger in the Fiat lost her life after being transported with the driver to University Hospital.  Fatal accidents raise the possibility of a legal issue known as a wrongful death.  A wrongful death occurs in Kentucky when one person loses their life due to the negligence or recklessness of another.

The questions of a wrongful death after a fatal accident on the Dixie Highway center on the relationship between the man and the woman in the Fiat.  The driver of the Fiat appears to have swerved to avoid hitting a car in front of them, ultimately causing the accident which resulted in the loss of his passenger’s life.  If the passenger was related to him, there is no legal case for a wrongful death.

However, if the passenger was unrelated to the driver of the Fiat, the family of the woman who lost her life should consider a wrongful death action against the driver.  The injured occupants of the southbound vehicles also have personal injury claims in this case.
